The class action lawsuit arose after allegations that Paycom inadequately protected customer data, resulting in a breach that compromised personally identifiable information. While the company does not admit any wrongdoing, the settlement will allow affected individuals to claim significant compensation.
What Affected Individuals Can Claim
- Out-of-Pocket Losses: Individuals who can document losses related to the breach may receive up to $2,500 each. This amount can cover expenses such as credit monitoring or costs incurred from identity theft.
- Time Spent Addressing Issues: Claimants can also request compensation for time spent resolving identity theft or fraud, which is compensated at a rate of $25 per hour, totaling up to $100.
- Higher Claims for Fraud Victims: Those who can demonstrate losses due to fraud or identity theft may claim up to $4,200.
- Credit Monitoring Services: Affected individuals can also apply for three years of credit monitoring services as part of the settlement.
The breach, which took place between July and October 2023, reportedly involved unauthorized access to client details via MOVEit Transfer, a secure file transfer application. The lawsuit contends that Paycom did not implement sufficient cybersecurity measures to protect client information.
